Under these terms & conditions "the photographer " and/or "me" and/or "I" shall mean Adam Gardner Photography. "The client(s)" are to be the named bride and groom or same sex couples as set out on the wedding booking. Any changes to the terms and conditions detailed within this contract may be subject to change at anytime, a change log is listed at the end of this document. This agreement shall be governed in accordance with the laws of England and Wales.

A deposit of 10% of the total fee is(non-refundable) is required to secure your wedding date and secure my time and services. This can be paid by bank transfer via Quickbooks option "Pay By Bank". The wedding deposit will be deducted from the final balance and the remainder of the fee must be paid by the client(s) 30 days prior to the agreed wedding date. Weddings that are postponed or re-scheduled to a later date shall retain the wedding deposit on the basis that the photographer is available to carry out agreed services on the re-scheduled date.
The payment plan allows the total balance for wedding services to be paid in instalments over an agreed period. The schedule, amounts, and due dates & payment amount will be outlined in your agreement confirmation email under section "Pricing & Payment"
Any requests to modify the payment schedule must be made in writing and are subject to approval. Changes are not guaranteed.
By completing and submitting the Wedding Agreement Form, you confirm that you have read, understood, and agreed to these payment plan terms and conditions.
Payment of all invoices is due immediately upon receipt. No grace period applies unless otherwise expressly stated in writing by me. The client acknowledges that timely payment is a material term of this Agreement. Payment can be made by accessing your account at admin.adamgardnerphotography.co.uk and entering your username and password, Debit/Credit card, via manual bank transfer (ACCOUNT NAME: ADAM GARDNER SORT CODE: 20 25 97 ACCOUNT NUMBER: 33 87 33 58), direct debit (powered by GoCardless) or standing order. Any invoices not paid within 72 hours when due will result in a late fee of £50 on any overdue balances as permitted by law. A late payment invoice is due upon receipt and must be cleared within 24 hours unless stated otherwise.
This contract may be cancelled by the client(s) at any time by giving notice to me in writing OR email. In cancelling this contract all monies paid shall be forfeited. Should this contract be cancelled within 30 days of the agreed wedding date then payment shall still be required in full. There is no cooling off period set within this contract. If there are any outstanding invoices at the time a cancellation request is submitted, all outstanding balances must be paid in full before the cancellation can be processed.
Should your latest invoice fall into arrears, this will be considered a breach of contract.
If payment has not been received within 24 hours of the invoice due date, a first payment reminder will be issued. If the invoice remains unpaid a further 24 hours later, a second reminder will be sent, providing a final 24-hour period to settle the outstanding balance and advising that a late payment fee will be applied.
If the invoice remains unpaid after this period, a £50 late payment fee will be charged in accordance with the Invoice Terms, and a separate invoice for this fee will be issued.
Should both the original invoice and the late payment fee remain unpaid 24 hours after the late payment fee invoice has been issued, a formal Letter Before Action will be sent. At this stage, services may be suspended or cancelled pending payment.
If all outstanding balances remain unpaid 24 hours after the Letter Before Action has been issued, all services will be cancelled, and legal proceedings to recover the outstanding debt may commence without further notice.
In the event that services are suspended or terminated due to non-payment, any payments made up to and including the date of the most recent invoice shall be non-refundable. The cancellation of services due to a breach of contract does not relieve the customer of their obligation to settle any outstanding balances, fees, or charges.
A secondary photographer, often referred to as a second shooter, plays a crucial role in various photography settings, particularly in events like weddings, corporate functions, and portrait sessions. Their primary responsibility is to assist the main photographer while capturing additional angles, moments, and details that might be missed by me. I take every effort to personally vet and ensure the 2nd photographer is up to the task. Public liability is essential for both parties. A second photographer will have an additional cost. This will be discussed and agreed with you and added to your total cost.
A timeline of the wedding day, including dates, times and locations will be agreed beforehand to ensure the photographer has an agreed plan for services required. Once the agreement has been submitted, a copy of this with your name, address, email, the wedding date, the total price, preferred payment date (if a payment plan has been setup) and your payment method will be automatically generated and will be visable in your customer portal.
It is often not possible due to ambient lighting conditions, to record the exact colour as seen by the human eye. In these circumstances I shall make every effort to deliver images with the closest match possible. My movements can sometimes be limited during ceremonies to certain areas that im not able to photograph from by the official in charge. During these circumstances I cannot be held liable for any obstructed view should this be the case. My judgement regarding the use of locations and poses of the subjects shall be deemed correct. Due to circumstances outside of my control such as the weather, it may not be possible to obtain all of the requested images as desired.
As a professional photographer, I understand that uploading photos of children requires strict adherence to privacy laws, ethical considerations, and digital safety standards. I always obtain explicit written consent from parents or legal guardians before sharing any images online and carefully consider the potential risks of posting children's likenesses.
You will receive some sneak peek images within 4 weeks. The fully edited images shall be delivered within 8 weeks. The images will be delivered via a password protected online gallery. I will share the unique links to your provided email address, in which you will be notified when the images are ready for viewing. The delivered images will stay valid for a period of 2months, in which after 2month they will be removed If you require a USB drive with the images on, please note that there is a fee of £30 which includes postage. The timings are based on a busy wedding photography season.
The client(s) agrees to give me creative freedom when it comes to editing and retouching images, with any specific requirements made in writing by the client(s) prior to the agreed wedding date. Images will be adjusted for brightness, exposure, contrast & sharpness. There are no set amount of images that will be edited and delivered. Should the client wish to have additional images edited, the client must submit this request with a list of image filenames to be edited within 4 months from the date when the images were delivered via Google Drive. Should the client submit the request after 4 months a quotation will be supplied.
The client(s) hereby allow(s) me to use any image produced for promotional purposes, including but not limited to website advertising, social media, brochures, magazine articles, sample albums etc. I cannot be held liable or accountable for malicious actions using these images by persons other than Adam Gardner Photography
This contract is subject to alteration or cancellation by either the client(s) or the photographer owing to any cause beyond their control. Should I be unable to carry out the agreed services due to circumstances beyond my control such as sudden illness, injury, victim of crime, flooding etc. liability shall be limited to a full refund of any fees paid. The photographer agrees to use professional grade photographic equipment and carry backups of all key equipment. Whilst all equipment is regularly serviced and its performance checked, the photographer will not be held responsible if unable to deliver services due to technical failure of the equipment.
Should I be unable to attend the wedding due to unforeseen circumstances, they will either appoint another photographer to carry out services or assist the client(s) in hiring another photographer of their choice. Limitation of Liability I cannot be held responsible for any personal accidents during a photographic shoot, these are participated in at the client(s) own risk. Where work is defective for any reason, the photographer’s liability (if any) shall be limited to rectifying such defect. I cannot be held responsible for and is not liable for any claims against me due to a delay in completing the work or transit of images.
The video may take upto 12weeks to edit and deliver during the busy wedding season.
CANCELLATIONS, POSTPONEMENTS, WEATHER CONDITIONS AND UNFORESEEN VARIABLES
External work and filming for the most part is subject to the elements and therefore is naturally affected by various flying conditions. Scheduled assignments requiring postponement that are caused due to weather conditions (i.e rain, strong winds) will incur no further charges to the client.
If wind and/or wind gusts exceed 20mph, it will be up to my discretion if the flight will be cancelled or postponed, several factors are taken into account when making a decision such as wind, wind gusts, reduced flight time, stability, safety measures such as: nearby obstacles (trees, buildings) that create turbulent, unpredictable winds.
The original 50% booking fee is retuned to the client upon flying conditions which may lead to a cancellation.
Cancelled assignments not caused due to weather or a mutually agreed change If a job is cancelled due to other issues and simply not re-scheduled due to the client no longer requiring our services the 50% deposit will be retained and therefore not be refunded. Any additional costs have been incurred will also have to be met by the client.
All photographs and video materials produced by me in the course of providing services, including all RAW (unedited) image files, remain the exclusive property of Adam Gardner Photography at all times.
Copyright in all images is retained by me in accordance with the Copyright, Designs and Patents Act 1988.
RAW (unedited) image files are NOT included in any package and will not be supplied to the Client under any circumstances.
Adam Gardner Photography reserves the right to retain all RAW image files as original works and evidence of authorship. These files may be used where necessary to establish, protect, or enforce copyright ownership, including in cases of suspected infringement, unauthorised reproduction, editing, distribution, or other misuse.
The Client must not reproduce, edit, alter, distribute, or commercially exploit any images without the prior written consent of the Adam Gardner Photography. Any breach of these terms may constitute an infringement of copyright under the Copyright, Designs and Patents Act 1988 and may result in legal action without notice.
By submitting the Wedding Agreement Form, you acknowledge and agree to these terms relating to copyright ownership and usage.
Client shall only use the digital files in accordance with the permissions within this agreement
The Client’s digital files are for personal use only OR in accordance with an expressly written licensing agreement negotiated between Client and Adam Gardner Photography.
Digital files shall not be submitted to contests, reproduced for commercial use without prior consent by Adam Gardner Photography, or reproduced in any way by parties other than Adam Gardner Photography.
Adam Gardner Photography grants the Client a non-exclusive, non-transferable, perpetual, personal-use license to reproduce Digital Images via print or other physical media only for non-commercial use, including but not limited to reprints, enlargements, gifts to family and friends, slide shows, and web pages. Commercial-Use Clients shall only use the digital files in accordance with the expressly written licensing agreement negotiated between Client and Adam Gardner Photography prior to use.
The Client may share blog post links and social media albums through use of the share functions and dissemination of direct links. All images posted on social media may require a direct link or credit towards Adam Gardner Photography if required by Contract. The Client shall not copy, screen shot, or capture the photographs in any other fashion. The Client also shall not significantly crop, edit, or add filters to any photographs.
Personal, Non-Commercial Use
Display on personal websites, mobile devices, tablets and computers
Making image prints or other physical media for personal use.
Resell, relicense, sub-license, redistribute without express written permission from Adam Gardner Photography
Use the Media in a obscene, illegal, immoral, libelous, or defamatory manner.
Approach anyone but Adam Gardner Photography to edit images produced by Adam Gardner Photography
Incorporate the Media into trademarks, logos, or service marks without express written permission from Adam Gardner Photography
Neither Adam Gardner Photography nor Adam Gardner Photography vendors will be liable for any third party claims or incidental, consequential or other damages arising out of this license or the Client's use of the Media.
This Agreement shall be governed by, and construed in accordance with, the laws of the United Kingdom (“Governing Law”).
This Agreement contains all the terms agreed to by the Debtor and Creditor relating to its subject matter and is subject to change as per necessary.
By completing, signing, and submitting the Wedding Agreement Form, you acknowledge and confirm that you have read, understood, and accepted these Payment Plan Terms and Conditions in their entirety. You further agree to be legally bound by all provisions contained within these terms, including but not limited to payment schedules, invoice due dates, late payment fees, service suspension or cancellation procedures, debt recovery actions, and the non-refundable nature of payments made in the event of service termination due to non-payment.
Your signature and submission of the Wedding Agreement Form constitute your explicit agreement to comply with all obligations set out within these Terms and Conditions. Failure to adhere to any payment obligations may result in the enforcement of the remedies described herein, including the application of late payment charges, suspension or cancellation of services, and legal action to recover any outstanding amounts.
By signing this agreement, you confirm that you have had sufficient opportunity to review these terms, seek independent advice if required, and enter into this agreement voluntarily and without reservation.
2nd June 2026 - New agreement in place which affects all current signed agreements
